Terms and Conditions

Hi, Welcome to Redfynd.

Redfynd is brought to you by Artyvis Technologies Private Limited. (referred to in these Terms as “we“, “us“, “our“, and “Redfynd“). By enrolling in or otherwise accessing or using any of our Services, you agree to be bound by these terms and conditions (the “Terms of Service“), and Redfynd’s privacy policy (“Privacy Policy“). We reserve the right, at Our sole discretion, to modify Terms and Conditions, at any time without any prior written notice to You. You shall ensure to review these Terms of Use periodically for updates/changes. Your continued use of the Platform following the posting of changes will mean that You accept and agree to the revisions.

Intellectual Property

All intellectual property rights including, but not limited to copyright, trademarks, text, blogs, graphics, user interfaces, visual interfaces, logos, artworks, graphics, articles, photographs, images, illustrations, and User images (collectively, “Content”) is the exclusive property of Artyvis Technologies Private Limited and its affiliates (“Redfynd”) or its respective licensors or owners (Redfynd has no control over such third party content as Redfynd is merely an intermediary for the purposes of this Terms of Use) and is protected by applicable legislation. Any commercial use, including the reproduction, modification, distribution and transmission of any content is strictly prohibited without the prior written consent of Redfynd or the respective owners.

Disclaimer of Liability

In no event shall (Redfynd) Artyvis Technologies Private Limited, and its subsidiaries, affiliates, officers, employees, partners and licensors will not be liable for any

  • Any matter relating to the service/business including, without limitation, loss of profits, sales, contracts, income, revenue, business opportunity, goodwill, reputation, wasted management or office time.
  • Any indirect, incidential, special, consequential or punitive damages,
  • The fulfilment of your orders from the listed stores/sellers in Redfynd once you have placed an order through Redfynd, including but not limited to the delivery, exchange, return or refund of items you have purchased from Redfynd partners or from the listed stores/sellers in Redfynd;
  • Any other damages resulting from the use or the inability to use the services or products, your delay in using, or inability to access or use the services, unauthorized access to or alteration of the user‘s transmissions or data, breach of condition, representations or warranties by the manufacturer of the products and stores.
  • Arising from any issue concerning the quality and warranty of the products ordered through redfynd from listed stores/sellers or our redfynd partners
  • Arising from any conduct or content of any third party on the services, including without limitation, any defamatory, offensive or illegal conduct of other users or third parties;
  • Redfynd shall not be held responsible for non-availability of the redfynd during periodic maintenance operations or any unplanned suspension of access to the redfynd .
  • The user understands and agrees that any material and/or data downloaded at redfynd is done entirely at users own discretion and risk and they will be solely responsible for any damage to their mobile or loss of data that results from the download of such material and/or data.

Cashback Program:

Our Cashback Program allows users who register on the Platform (“Members”) and therefore create an account with us (“Account”) to earn cashback by making purchases from the retailers listed on Our Platform (“Retailers”). To qualify for cashback, the Retailer must confirm that the Member's purchase is tracked, genuine and successful (constituting a “Qualifying Transaction”), and your resulting cashback must be received by us (becoming “Cashback” as a result). The earned Cashback can be withdrawn via any of the Cashback/Reward Receipt Methods but only after reaching the minimum limit of threshold set by Us. It's important to note, that not every Retailer listed on our website participates in the Cashback Program.

A transaction is termed to be a qualified transaction where, the user is redirected by Redfynd to the Retailer's platform /Website making a valid and subsisting purchase after which the Product/service is duly delivered, and the refund/return period has also expired

If the Retailers do not track a transaction using their affiliate tracking system, then such sales might not be paid to Redfynd, and hence any due or expected cashback from these sales will also not be paid to the Member.

Cashback:

After a Member successfully completes a Qualifying Transaction, and once we have received the resulting Cashback for that Qualifying Transaction, we pass that Cashback to the Member through his/her Cashback Receipt Method.

Please note that there are various circumstances in which a transaction with a Retailer may not constitute a Qualifying Transaction, or Cashback may not result from it. The Member understands that all transactions made by him/her are not with us, but with the individual Retailer. Further, from time-to-time Retailers may increase or decrease or stop the commission paid - in which case the Cashback offer illustrated on our platform may be incorrect/outdated. By default, your applicable transactions will be credited in line with the commission reported to us by the Retailer, which may be more or less than the advertised rate. We shall not be liable for any difference in the expected Cashback by the Member and the actual Cashback received by the Member.

When we have traced a paying, Qualifying Transaction to your Account, we will credit your Account with a 'pending payment'. Once the Retailer confirms the transaction, the payment will be marked as 'validated' - this can take 90 days or more from the date of the purchase. If the goods are returned or the sale reversed or amended by any means, then the cashback payment will not be made. Apart from the Retailer, it is also mandatory for the members to notify Redfynd about any returns or exchanges for which they might have earned cashback unduly.

Whether a transaction shall qualify as a Qualifying Transaction (including cashback through a Qualifying Referral) shall be at the sole discretion of the Retailer or Us and the Member understands and agrees to the same. We shall not be held responsible if the Retailer fails to report a sale to us or does not qualify a transaction as Qualifying Transaction. Further, we shall not be responsible in the event due to some technical or other errors we cannot trace a sale back to the Member and does not qualify the transaction as a Qualifying Transaction or a Qualifying Referral for any reason whatsoever. Whilst we will endeavour to recuperate non-payments from the Retailer, the decision of ourselves, the Retailer or Retailer's tracking agent shall stand final. Whilst we will try and recuperate missing commissions, at any point as well as, we reserve the right not to chase missing commission claims, particularly where no purchase has been made.

Further, if the Retailer feels that the purchase is not genuine for any reason whatsoever and we do not receive any commission for the transaction, the Member will not receive any Cashback.

When a Member sends us an enquiry on missing cashback via raising a ticket, our system would check if the user had an exit click from our Platform for that store on the date mentioned by the user. If no exit clicks can be tracked, then the Member will be indicated that they did not click via our website to earn cashback/reward prior to the sale. All exit clicks to stores are saved in the database for cross reference on adding cashback/reward values. Where a commission enquiry has been successfully paid by a Retailer, you may receive a lower amount than expected; this is due to the amounts received by us possibly being lower than the original claim. We do allow you to raise a query with us. If a Retailer still hasn't paid a manual commission claim after a period of six months, then we reserve the right to close the enquiry claim. All payment for Missing Cashback is only applicable in instances where the Retailer pays Redfynd.

Note: The User raising or intending to raise a ticket in case of an enquiry of missing cashback shall raise the same within 10 (Ten) days from the date of the transaction. No claim shall be entertained by any registered User post the stipulated timeline

We reserve the right to reclaim or make balance adjustments accordingly where it has been established that any credit has been applied in error. This will include but is not limited to transactions where the credit is not genuinely due or payment for any credited transaction has not been received from a Retailer or its agencies and/or misuse or fraud. This can include transactions which are already marked as payable or validated in your Account, or for transactions which have already been paid over to you by Gift Cards/wallets, UPIs or any other payment modes as We may introduce from time to time. In all such incidences, Redfynd has the right to recover all unduly paid cashback which the member is not entitled to earn, through legal proceedings.

The User while raising a pay-out request, shall ensure choosing the withdrawal method (Bank Transfer, Gift Card/wallet, UPIs, etc.) containing the correct credentials and if the customer provides incorrect details and we process the pay-out(s), we shall not bear any liability against the same. Such, negligence shall be seen as the User's error.

There are various circumstances in which Cashback will not be payable to the Member, and will be forfeited by us, these could be, without limitation:

  1. Where the cashback payment that we receive is not attributed to a Qualifying Transaction or associated with an Account (such as where the Member is not logged-in to our Platform when making the relevant purchase)
  2. The transaction to which the Cashback relates is cancelled if it has been associated with any fraudulent activity or any breach of this Agreement.

Referral Program Overview:

The Referral Program is designed to incentivise existing Members of a platform by offering them a referral bonus for each new Member they introduce. Member will only receive such referral bonus as cashbacks for 'Qualifying Referral'.

We are persistent to enhance our referral programme and we retain the right to modify any referral programme terms at any time and without notice.

Qualifying Referral:

A referral qualifies when a referee and referrer both have earned certain amount of validated cashback, decided by the store at the time. Until the criteria are met, bonuses remain pending.

Validity of Cashback:

Acknowledgment: You acknowledge that the Redfynd Cashback - Pending or/and Validated will expire if you do not login to your Redfynd account for a continuous period of 6 months.

Preventing expiry of Cashback: To prevent your Cashback from getting expired, you must login to your Redfynd account at least once every 6 months.

Expired Cashback: Upon expiry, this amount shall be removed from Order Details page and will be listed under “Expired Cashbacks” menu as a single entry. Such expired Cashback will not be withdrawable by you.

Your Account:

You can redeem your validated cashback once you've reached the minimum cashback threshold in your Account. However, if you decide to delete your Account, regardless of whether the validated or pending cashback in your account is above or below the minimum threshold limit, the entire balance will be forfeited. If your validated cashback meets or exceeds the minimum threshold limit before you choose to delete your account, you can request payment of the same via any of the Cashback/Reward Receipt Methods. Please note, upon account deletion, we reserve the discretion to forfeit any balance, validated or pending, displayed in your Account.

Operation of our Cashback Program:

We reserve the right to modify, suspend, or withdraw parts or the whole Referral and/or Cashback Program for various reasons, including legal, security, technical, or commercial concerns. While we aim to provide a week's notice for any changes, immediate actions may be necessary for security or to address technical issues. Although we strive to maintain access to the Cashback and/or Referral Program, we cannot guarantee it will be uninterrupted due to potential technical difficulties, either from our end or general internet issues. We'll make every effort to resolve such issues within our control.

For security purposes, we may ask you to update your password or other access information, but we will never request your password through email, phone, or any means outside the Platform. The responsibility to keep your password and account information secure rests with you.
